The primary attorney with the experience commensurate with the complexity of the case, will usually handle the litigation. The secondary attorney is assigned to be available to help the primary attorney should any scheduling conflicts arise or should it be more economical and feasible for an associate or junior associate attorney to handle particular matters, as opposed to the primary attorney. Two attorneys will not attend a hearing, deposition, etc. unless it has been specifically approved. The secondary attorney will very likely work on the file but, will not duplicate time and services performed by the primary attorney.
